Tape Reports

Today's Federal rules treat electronic documents, including email and instant messaging, the same as paper-based documents. All are viewed as discoverable, although backup tapes can be exempted as reasonably inaccessible if used for disaster recovery purposes. However, the amendments to the Federal Rules of Civil Procedure have enabled these backup tapes to be considered as discoverable, as of their adoption on December 1, 2006.
